BY PARTICIPATING IN THE “FIND THE AFRICAN ROYALE IN YOU” CONTEST (THE “CONTEST”), YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THESE OFFICIAL RULES INCLUDES INDEMNITIES FROM YOU IN FAVOR OF THE SPONSOR AND OTHER THIRD PARTIES, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

THE CONTEST IS OPEN ONLY TO PERMANENT, LEGAL RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA (PROVIDED THAT THE CONTEST IS VOID FOR RESIDENTS OF FLORIDA, NEW YORK, PUERTO RICO, ALL U.S. TERRITORIES AND POSSESSIONS, ALL OVERSEAS MILITARY INSTALLATIONS AND WHEREVER ELSE PROHIBITED BY LAW) WHO ARE AT LEAST TWENTY-ONE (21) YEARS OF AGE AS OF THE COMMENCEMENT OF THE CONTEST PERIOD (AS DEFINED BELOW). 

THE CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, INSTAGRAM, INC., FACEBOOK, INC.,  OR TWITTER, INC.

1. CONTEST PERIOD

The “Find the African Royale in You” contest (the “Contest”) begins on November 1, 2023, at 12:00:01 a.m. Pacific Time (“PT”) and ends on December 15, 2023, at 11:59:59 p.m. (PT) (the “Contest Period”).

The period during which you may submit an entry to the Contest, as described below (the “Video Entry Period”) begins on November 1, 2023, at 12:00:01 a.m. PT and ends on November 24, 2023, at 11:59:59 p.m. PT.  Finalists will be selected during the period starting on November 25, 2023, at 12:00:01 a.m. PT and ending on November 30, 2023, at 11:59:59 p.m. PT (the “Finalist Selection Period”).  Likes for finalists shall be counted during the period starting on December 1, 2023, at 12:00:01 a.m. PT and ending on December 15, 2023., at 11:59:59 p.m. PT (the “Voting Period”).

Sponsor’s computer is the official timekeeping device for the Contest.  At the end of the Contest Period, one (1) potential Grand Prize winner will be selected from the five (5) finalists selected as described below.

2. ELIGIBILITY

The Contest is open only to permanent, legal residents of the United States and the District of Columbia (provided that the Contest is void to residents of Florida, New York, Puerto Rico, all U.S. territories and possessions, all overseas military installations and wherever else prohibited by law). In addition, the Grand Prize winner (and their traveling companion) must have a valid U.S. passport for international travel.  Employees of The Africa Channel, Inc. (“Sponsor”) and each of Sponsor’s parents, affiliates, subsidiaries, advertising and promotion agencies and prize providers (“Contest Entities”), and their immediate family members and/or those living in the same household of each, whether related or not, are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners.

3. HOW TO ENTER

During the Video Entry Period from November 1, 2023 through November 24, 2023, you may enter the Contest by completing all three of the following actions:

1. Following @AfricaChannelTV on Instagram;
2. Posting a 30-60 second video on Instagram explaining why you want to find your African heritage and visit Africa and what you hope to learn from the experience; and
3. Tagging @AfricaChannelTV and using hashtag #AfricanRoyale_Contest and #WatchAfricanRoyaleOnTAC.

All entries submitted must be received by 11:59:59 p.m. PT on November 24, 2023 (i.e., by the end of the Video Entry Period). Limit one (1) Contest entry per eligible person. Multiple entries received from any person beyond this limit will void all such additional entries.

4. SELECTION OF WINNER

During the Finalist Selection Period, The Africa Channel’s Celebrity/Influencer selection panel (the “Panel”) will select five (5) potential Finalists for the Contest, from all eligible video entries received during the Video Entry Period.  The Panel is comprised of cast members from the television program “African Royale” and will judge all eligible entries based on which entry, in their opinion, best answers the questions of why the entrant wants to explore their ancestry by visiting Africa, and what the entrant hopes to learn from the experience.  The Panel’s decision will be based on the following criteria: (1) originality and creativity – 50%; and (2) content – 50%.

Three (3) potential Grand Prize winner will be chosen based on the entries selected by the Panel above that receive the most likes for a Finalist’s video post on The Africa Channel Instagram page @africachanneltv during the Voting Period for Grand Prize from December 1, 2023 through December 15, 2023.  From those three (3) potential Grand Prize winners, the Panel will select a Grand Prize winner based on the criteria described above.

AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

The potential Grand Prize winners will be notified via direct message, by phone, text message and/or email, according to the method of verification specified in the potential Grand Prize winners’ entry forms.  IT IS THE ENTRANT’S SOLE RESPONSIBILITY TO ASSURE THAT HIS/HER PRIVACY SETTINGS ARE CONFIGURED SO AS TO ACCEPT SUCH DIRECT MESSAGE, PHONE, TEXT MESSAGE AND/OR EMAIL NOTIFICATIONS (AS APPLICABLE).

For the three (3) potential Grand Prize winners, response is required to such notification within seventy-two (72) hours from the time of first notification (i.e., phone or text message and/or email transmission). Such response must include additional contact information for immediate prize acceptance and coordination.  Potential Grand Prize winners will be required to complete and return an Affidavit of Eligibility, Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release within one (1) day of first notification confirmation. Potential Grand Prize winner agrees that an electronic signature shall have the same legal force and effect as signing these documents by hand.  In the event any potential Grand Prize winner cannot be contacted, fails to comply with these time periods, or his/her prize notification or required documents are returned as undeliverable, or he/she is disqualified for any reason, Sponsor may choose an alternate potential Grand Prize winner in the manner set forth above, time permitting.

5. PRIZES/APPROXIMATE RETAIL VALUE

The three (3) Finalist winners will each receive an African Ancestry Kit. Approximate retail value:  $299.00 per kit.

There will be one (1) Grand Prize winner awarded following the conclusion of the Contest Period.  The Grand Prize winner, upon confirmation of eligibility, will receive a six (6) day, five (5) night trip to Ghana, Africa for the Grand winner and one (1) adult guest – Approximate Retail Value $9,000.00.  Trip will include:

1. Economy round-trip tickets (airline and travel to be determined and arranged by Sponsor);
2. Hotel stay at Lancaster Accra- 4 Star Hotel or similar based on availability, double occupancy room (i.e., the Grand Prize winner and guest will share a room);
3. Airport pickup and drop off;
4. Breakfast daily at the hotel and one traditional meal during stay;
5. Opportunity to attend the following guided experiences – Traditional Naming Ceremony & Cooking Experience, Cape Coast Castle Experience , Accra City Tour Experience;
6. Support from Sponsor’s designee, Certified Africa, with questions regarding visas, immunizations and other travel pre qualifications.

Roundtrip tickets for two will be in the form of a travel voucher and/or travel credit departing from the nearest international airport from the Grand Prize winner’s residence, and must be used within a year from the date the Grand Prize is awarded.

If the actual value of the prize is less than the stated ARV, the difference will not be awarded. The Released Parties shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations.

All prize-related travel and accommodations must be booked by the Grand Prize winner within such time periods as may be prescribed by the applicable airline and/or hotel, as applicable.  Any and all travel vouchers, travel credits, and accommodations included as part of the Grand Prize are valid for travel within twelve (12) months from the date the Grand Prize is awarded.  Accommodations include one room (double occupancy).  Redeemed travel and accommodations are subject to availability.  Airline seats may not be available on all flights, and hotel rooms may not be available at all times.  Blackout dates may apply (including, without limitation, Thanksgiving and Christmas), and travel may be capacity controlled.  Travel vouchers may be redeemed only in accordance with restrictions identified on or in connection with the applicable voucher.  Travel vouchers are not redeemable for cash and have no cash value, and are non-transferable, non-endorsable, non-refundable and non-reroutable.  If the Grand Prize winner elects not to accept any tickets, gift card and/or debit card included as part of the Grand Prize winner’s award, the Grand Prize winner will not receive the cash value of the tickets, gift card or debit card and no additional compensation will be awarded in lieu thereof.  Use of such tickets, gift card and/or debit card prize subject to terms and conditions of use (including expiration) as published or indicated thereon.  Change and cancellation restrictions and fees may apply to travel and accommodations reservations.  Additional prize award details to be provided to the winner at the time of notification.

The Grand Prize winner’s companion must be eighteen (18) years old as of the date of departure and must travel on the same itinerary as the winner. The Grand Prize winner’s companion must also execute liability/publicity releases prior to travel. The Grand Prize winner and companion are solely responsible for obtaining documents necessary for their respective international travel (i.e. passport/visa). Restrictions, conditions and limitations may apply.

All expenses associated with Grand Prize acceptance and use not specifically mentioned herein as being provided, including, but not limited to: travel to/from the airport of departure/return, all federal, state and local taxes, luggage fees, hotel taxes, additional ground transportation at the Grand Prize winner’s destination(s), travel insurance, room service, bag check fees, parking fees, laundry service, food, merchandise, souvenirs, telephone calls, tips, gratuities and service charges are the sole responsibility of the winner.   

Unclaimed and/or unused prize/prize component will be forfeited by prize winner and will remain the property of Sponsor. Prizes are non-transferable, non-assignable and have no cash value. No prize substitution or cash redemption allowed by prize winner.  Sponsor reserves the right to substitute the prize or any element thereof for a prize or element of equal or greater value. All income taxes are the sole responsibility of winner. The Grand Prize winner must note that the value of the accepted prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of the prize. In no case will more than the stated number of prizes be awarded. No portion of prize may be sold, bartered or exchanged by prize winner. If awarded, prizes will be awarded without any warranty from Sponsor of any kind.  Limit one prize per person/family/account-holder.

Acceptance of any prize constitutes permission for the Sponsor and its designees to use winner’s name and/or likeness for purposes of advertising and trade in connection with the Promotion, in any and all media now known or hereafter developed, worldwide, in perpetuity, without further compensation, including on a winners’ list, unless prohibited by law.

6. GENERAL RULES

All federal, state and local laws and regulations apply.  By entering the Contest, each entrant agrees: (i) to be bound by these Official Rules and by all applicable laws and decisions of Sponsor which shall be binding and final; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of his/her rights to bring any claim, action, or proceeding against any of the Promotion Entities in connection with the Contest; and (iv) to forever and irrevocably release, defend, indemnify, and hold harmless each of the Contest Entities, Instagram and each of their respective officers, directors, employees, agents, shareholders, representatives, successors and assigns (collectively the “Releasees”), from any liability (including, but not limited to, liability for defamation, libel, slander, invasion of privacy, right of publicity or infringement or violation of any intellectual property or other rights, any property loss, damage, personal injury, bodily injury, death, expense, accident, delay, inconvenience or irregularity, and any indirect, incidental, consequential, special, punitive or exemplary damages of any kind even if the Releasees have been advised of the possibility of such loss or damages), costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with: (a) the Contest, including, but not limited to, any Contest-related activity or element thereof, and the entrant’s entry, participation or inability to participate in the Contest; (b) the violation of any third party privacy, personal, publicity or proprietary rights; (c) typographical errors in these Official Rules or any promotional materials relating to the Contest; (d) acceptance, possession, defects in, delivery of, use, misuse or inability to use any prize (or any component thereof); (e) any change in the prizing (or any components thereof) due to unavailability or due to reasons beyond Sponsor’s control; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Contest Entities, or any of their agents or employees; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the collection, use and/or sharing of entrant’s personally identifiable information by Sponsor or its designees. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Contest or use or redemption of any prize. All prizes are provided as-is without warranty of any kind.  Entrants agree to release, discharge and hold harmless Releasees from and against any and all liability and damages. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. Contest Entities are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize winners.

NOTICE TO ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Releasees are not responsible for faulty, incorrect or mistranscribed electronic transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person’s mobile device or computer related to or resulting from participating in or experiencing any materials in connection with the Contest, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer or phone transmission that may limit a user’s ability to participate in the Contest. Sponsor reserves the right to cancel or modify the Contest if fraud, misconduct or technical failures destroy the integrity of the Contest; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Contest as determined by Sponsor, in its sole discretion. In such event, Sponsor may make the prizes available to be won in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any entries which are suspected of being fraudulent (including those using robotic, automatic, programmed or similar methods of participation) will be disqualified, based on determinations made solely by Sponsor. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

7. PRIVACY POLICY

All information collected by Sponsor in connection with the Contest entries will be subject to Sponsor’s Privacy Policy available at https://theafricachannel.com/privacy/.

8. WINNERS’ LIST

For the first name, last initial and state of prize winners, send an email with Subject Line: “THE AFRICA CHANNEL FIND THE ROYALE IN YOU CONTEST” to  info@theafricachannel.com. Requests must be received by 5:00:00 p.m. PT, Friday, December 30th, 2023.

9. DISPUTES

The Contest, including the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of California without regard to choice of law or conflict of law principles, which would cause the application of the laws of any jurisdiction other than the State of California.  Any dispute, claim or cause of action arising out of or connected in any way with the Contest or the award of prizes shall be resolved individually, without resort to any form of class action, and brought exclusively in a federal or state court in Los Angeles County, California.  Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees, and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages (other than for actual out-of-pocket expenses, if any), and any and all rights to have damages multiplied or otherwise increased.

10. NO INJUNCTIVE RELIEF

EACH ENTRANT UNDERSTANDS AND AGREES THAT HE/SHE SHALL HAVE NO RIGHT TO ENJOIN OR RESTRAIN THE DEVELOPMENT, PRODUCTION, ADVERTISING, PROMOTION, DISTRIBUTION OR EXPLOITATION OF THE CONTEST OR ANY OTHER PRODUCTION OR PROJECT OF SPONSOR, ITS LICENSORS OR ANY OF THEIR RESPECTIVE PARENTS, SUBSIDIARIES OR AFFILIATES.
